Cooperative divorce is not a substitute for the Collaborative process; rather, it is an alternative for families who have different procedural preferences. It may be the right path for:

 

  • Those Preferring a Smaller Circle: If you feel your situation is straightforward enough that it doesn't require the integrated "full team" (such as neutral financial experts or divorce coaches) used in Collaborative Law, the cooperative model keeps the process lean.

  • Individuals Valuing Continuity: Collaborative Law requires both attorneys to withdraw if the process moves to court. Cooperative divorce is for those who want the security of knowing their attorney can stay by their side even if a settlement cannot be reached.

  • Proactive Communicators: Spouses who are ready to work together in good faith but prefer a direct, attorney-to-attorney negotiation style over the structured "participation agreement" of the Collaborative model.
